1. Introduction

These Terms of Service ("Terms") govern the use of the Fresh Ekie Enterprise platform, website (www.freshekie.com), offices, digital channels, and any related communication systems. Fresh Ekie Enterprise is a registered business operating from Mile 17, Buea, Cameroon, providing digital payment facilitation, bill payment support, currency-related services, and other permitted financial support services.

By accessing or using our services, you agree to comply with these Terms.

2. Eligibility

Users must be at least 18 years old and legally capable of entering into binding agreements. Users agree to comply with all applicable laws, regulations, and compliance requirements. Fresh Ekie reserves the right to request identity verification, business documents, or additional information to meet regulatory and risk-management obligations.

3. Account Registration and Security

Access to certain services may require account registration. Users must provide accurate and complete information and are responsible for safeguarding their login credentials. Fresh Ekie is not liable for losses arising from unauthorized access due to user negligence. Suspicious activity may result in account suspension or termination.

4. Scope of Services

Fresh Ekie facilitates digital payment services including:

  • Utility and subscription bill payments

  • Digital value services (airtime, data, subscriptions)

  • Currency-related services subject to availability and compliance

  • Digital payment processing support through approved partners

Fresh Ekie does not operate as a bank and does not hold customer funds beyond what is required to complete authorized transactions.

5. Transaction Processing

By initiating a transaction, users authorize Fresh Ekie to process the transaction according to the details provided. Users are solely responsible for the accuracy of transaction information. Processing times may vary due to compliance checks, third-party systems, or external service providers.

6. Authorized Payment Channels

All payments to Fresh Ekie must be made only through officially designated channels communicated by the company. Fresh Ekie does not accept responsibility for funds sent to unauthorized persons or accounts. Users are advised to verify payment instructions before sending funds.

7. Fees and Pricing

Applicable fees, where any, are disclosed before transaction confirmation. Fees are non-refundable once a transaction has been processed, except where required by law or operational failure attributable to Fresh Ekie.

8. Exchange and Value Determination

Where applicable, rates or values are determined at the time of transaction processing. Once confirmed, transactions are final and cannot be adjusted retroactively.

9. User Obligations

Users agree not to use Fresh Ekie services for unlawful purposes, including fraud, money laundering, terrorism financing, or prohibited activities. Users must comply with all KYC, AML, and compliance requests.

10. Failed or Disputed Transactions

Users may report transaction issues for investigation. Fresh Ekie will make reasonable efforts to resolve issues in coordination with partners but is not liable for failures caused by third-party systems or incorrect user input.

11. Refund Policy

Refunds are only possible for transactions that have not been completed or settled. Completed transactions are generally irreversible unless permitted by the receiving institution.

12. Prohibited Activities

Fresh Ekie strictly prohibits use of its platform for illegal activities, including but not limited to fraud, impersonation, unauthorized financial services, or regulatory evasion. Violations may result in suspension and reporting to authorities.

13. Limitation of Liability

Fresh Ekie is not liable for losses resulting from:

  • Incorrect user-provided information

  • Third-party service failures

  • Network, system, or operational disruptions beyond its control

Services are provided on an "as-available" basis.

14. Data Protection and Privacy

User data is processed in accordance with applicable data protection laws. Information is used strictly for service delivery, compliance, and legal obligations. Data is not sold to third parties.

15. Service Availability

Fresh Ekie may temporarily suspend services for maintenance, security, or regulatory reasons without prior notice.

16. Customer Support

Support is available via official phone numbers, email, WhatsApp, or physical office locations as communicated by Fresh Ekie.

17. Amendments

Fresh Ekie may update these Terms to reflect regulatory, operational, or business changes. Continued use of services constitutes acceptance of updated Terms.

18. Governing Law

These Terms are governed by the laws of the Republic of Cameroon. Any disputes shall be resolved under Cameroonian jurisdiction.

19. Acceptance

By using Fresh Ekie services, users confirm that they have read, understood, and agreed to these Terms.
